Hash Poker Terms of Service

These terms govern your use of the Hash Poker app (the "App"), operated by Bitlabs Latam SAS ("Bitlabs", "we", "us"). By signing in or using the App, you agree to these terms and to the Hash Poker Privacy Policy. If you do not agree, do not use the App.

1. Play money only

Hash Poker is a social poker game for entertainment. It offers no real-money gambling and no opportunity to win money or prizes of real-world value. Practice or success at social poker does not imply future success at real-money gambling.

2. Eligibility

You must be at least 18 years old, and old enough to use the App where you live. You may not use the App where doing so is against the law.

3. Your account

You sign in with Google or Apple. You are responsible for activity on your account and for keeping that sign-in account secure. Your display name and profile photo are visible to other players. Accounts are personal: do not sell, share or transfer yours.

4. Virtual currencies

The App uses three virtual currencies: Tokens, Gold and Diamonds. They:

• have no cash value and cannot be cashed out, redeemed for money or anything of value, or transferred outside the App;
• are a limited, revocable license to use within the App, not property you own;
• are forfeited when your account is deleted or closed.

Diamonds can be bought through the Apple App Store and exchanged for Gold; that exchange is one-way. We may change prices, rewards, what each currency buys, and the free Tokens and login rewards we offer.

5. Purchases and refunds

Purchases are made through Apple and are subject to Apple's terms. Except where the law requires otherwise, purchases are final; refund requests are handled by Apple. If Apple refunds a purchase, we remove the Diamonds it credited. If you have already spent them, your Diamond balance is repaid from your next purchase.

6. Fair play and conduct

You agree not to:

• cheat, collude with other players, or share information about your cards with anyone at the table;
• use bots, scripts or other automation to play or to collect rewards;
• use more than one account to gain an advantage, or to collect extra rewards;
• exploit bugs, or interfere with the App or its servers;
• harass, threaten or abuse other players, including through emotes and gifts;
• use a name or photo that is offensive, sexual, hateful, or that impersonates someone else;
• buy, sell or trade accounts or virtual currencies outside the App.

You can block a player's emotes and gifts, and report a player, from their profile at the table.

7. Game results

Our servers shuffle, deal and apply the rules; their record of each hand is final. Some seats may be played by computer-controlled players that we operate. If a fault or maintenance interrupts a hand, we may void it and return the chips that were in play.

8. Your content

You keep ownership of the name and photo you use in the App. You give us permission to store and display them to other players while your account is open. You confirm you have the right to use them.

9. Moderation and termination

We may hide a photo, reset a name, remove chips gained by breaking these terms, or suspend or close an account that breaks them. You can delete your account at any time in the App (Profile, then Settings, then Delete account).

10. Changes and availability

We may change, add or remove features, and we may pause or end the App. When we change these terms in a material way, we will tell you in the App before the change takes effect. Continuing to use the App after that means you accept the new terms.

11. Disclaimers and liability

The App is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. To the extent the law allows, Bitlabs is not liable for indirect or consequential losses, or for the loss of virtual currencies. Our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

12. Apple

These terms are between you and Bitlabs, not Apple. Apple is not responsible for the App, its content, maintenance, support or any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. Governing law

These terms are governed by the laws of Colombia, without regard to conflict-of-law rules.
